Accelerated Rehabilitative Disposition (ARD)
(Section 3807)
ARD is a program that is available for first time offenders under certain circumstances.
*No one will be considered for the ARD program if they have a prior conviction for a major crime (either in Pennsylvania or any other jurisdiction).
If you have never been convicted of such a crime you can still be denied entrance into the ARD program if you have had any of the following:
- A prior DUI ARD or conviction in the last 10 years unless the charge was for a violation of the 3802(a)(2)(BAC between .08 and .099)
- There was an accident, which occured in connection with the current offense, and an individual other than the defendant was killed or suffered serious bodily injury as a result of the accident.
- There was a passenger under 14 years of age in the motor vehicle the defendant was operating.
If accepted into the ARD program, you must:
- Successfully attend and complete the Highway Safe Driving School.
- Complete a CRN evaluation.
- Successfully attend and complete any and all alcohol treatment in a licensed alcohol or drug addiction treatment program.
- Be on probation for at least 6 months, no more than 1 year.
- Make restitution if applicable.
- Pay court costs.
- Perform community service if required.
If a person is accepted into the ARD Program, their Pennsylvania Operating Privilege will be suspended as follows:
- .08% to .99% BAC - No license suspension.
- .10% to .159% BAC - 30 day license suspension.
- .16% or higher or BAC unknown or accident causing damage to person - 60-day suspension.
- DUI from Drugs or if a refusal to take chemical test - 60 day suspension
- If you are under 21 at the time of the offense - 90 day suspension.
